By accessing and using Preshiplist ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
Preshiplist is a waitlist management platform that allows users to create, manage, and host waitlist pages for their products and services. Our platform provides tools for collecting signups, managing email campaigns, and analyzing waitlist performance.
3. User Responsibilities and Data Ownership
Important: Data Ownership and Control
As a waitlist owner using Preshiplist, you have full access and control over all email addresses and personal information collected through your waitlist pages. Preshiplist acts solely as a service provider and data processor.
3.1 Data Ownership: You retain full ownership of all data collected through your waitlist pages, including but not limited to email addresses, names, and any other personal information submitted by your waitlist subscribers.
3.2 Data Control: You have complete control over how you use, store, and process the personal information collected through your waitlist. This includes the right to export, delete, or transfer this data at any time.
3.3 Legal Responsibility: You are solely responsible for ensuring that your collection and use of personal information complies with all applicable privacy laws, including GDPR, CCPA, and other relevant regulations.
3.4 Preshiplist's Role: Preshiplist serves as a data processor, providing the technical infrastructure for your waitlist pages. We do not own, control, or have any rights to the personal information collected through your waitlists.
4. Acceptable Use
You agree not to use the Service to:
- Collect personal information without proper consent and legal basis
- Violate any applicable privacy laws or regulations
- Send spam, unsolicited emails, or engage in deceptive practices
- Infringe on intellectual property rights
- Transmit malicious code or attempt to compromise the Service
- Use the Service for any illegal or unauthorized purpose
5. Limitation of Liability
5.1 Service Provider Disclaimer: Preshiplist provides the technical infrastructure for waitlist management. We are not responsible for:
- How you use the personal information collected through your waitlists
- Your compliance with privacy laws and regulations
- The content or accuracy of information on your waitlist pages
- Any disputes between you and your waitlist subscribers
5.2 Maximum Liability: In no event shall Preshiplist's total liability exceed the amount paid by you for the Service in the 12 months preceding the claim.
6. Refund Policy and Money-Back Guarantee
Conditional Refund Policy
We offer a conditional money-back guarantee for all paid subscriptions. Refunds are available only when specific usage conditions are met to prevent abuse while protecting genuine customers.
6.1 Refund Time Windows:
- Monthly subscriptions: 30-day money-back guarantee from initial subscription date
- Quarterly subscriptions: 60-day money-back guarantee from initial subscription date
- Yearly subscriptions: 90-day money-back guarantee from initial subscription date
- Lifetime subscriptions: 30-day money-back guarantee from purchase date
6.2 Eligibility Requirements:
To qualify for a refund, you must meet at least one of the following conditions at the time of your refund request:
- No published waitlists: You have not published any waitlist during your subscription period, OR
- Minimal signups: You have collected fewer than 10 total signups across all your published waitlists
Important: Why These Conditions Exist
Preshiplist delivers immediate value upon successful waitlist creation and signup collection. Once you've published a waitlist and collected signups, you retain those signups and their value permanently, even after cancellation.
The refund conditions prevent abuse while ensuring genuine customers who don't find value in the platform are protected.
6.3 What You Keep After Refund:
- If you qualify for a refund, you may still keep any signups collected (up to 10) and export them
- Your account will be downgraded to the free plan
- All published waitlists will be unpublished
- Your data remains accessible for export at any time
6.4 Refund Process:
To request a refund, contact us at support@preshiplist.co with your account email and subscription details. We will verify your eligibility and process approved refunds within 5-10 business days to the original payment method.
6.5 Non-Refundable Items:
- Add-on services purchased separately (if any)
- Subscriptions beyond the refund time window
- Subscriptions that don't meet the eligibility requirements
6.6 Free Plan Alternative:
We strongly encourage users to thoroughly test our platform using the free plan before upgrading. The free plan provides full access to all customization options and the complete waitlist creation experience, with the only limitation being the ability to publish live waitlists.
7. Third-Party Services and Subprocessors
We use reputable third-party service providers (subprocessors) to help us deliver the Service, including hosting, analytics, and customer communications. By using the Service, you authorize us to engage such providers. We require all subprocessors to implement appropriate technical and organizational measures to protect personal data and to process personal data only for the purposes we specify.
